First Offense DUI

First Offense DUI Attorney in Coeur d’Alene

Trial-Ready DUI Defense for North Idaho Clients

A first DUI arrest sets two legal processes in motion at once, and the decisions made in the first few days matter. At Walsh & Lewis PLLC, we represent clients facing first-offense DUI charges in Coeur d’Alene and throughout North Idaho, preparing each case as though it were headed to trial before advising on how to proceed.

Don’t navigate a DUI arrest alone. Call our Coeur d’Alene criminal defense attorneys at (208) 712-8292 to discuss your options.

Two Separate Cases, One Arrest

An Idaho DUI arrest triggers two distinct legal tracks. The first is an Administrative License Suspension (ALS), an automatic action against your driving privileges that runs entirely separate from your criminal case. Idaho law gives you a short window after your arrest to request a hearing challenging that suspension. Miss it, and you lose the opportunity to contest it.

The criminal case follows its own timeline through arraignment, pretrial proceedings, and potentially trial. Evidence typically includes field sobriety test results, breath or blood test data, and the arresting officer’s observations. Both tracks require prompt attention, and we address both simultaneously from the start.

What a First Offense DUI Conviction Can Cost You in Idaho

Under Idaho Code 18-8004, a blood alcohol concentration (BAC) of 0.08 percent or higher is sufficient for a DUI charge for drivers 21 and over. A first offense is generally charged as a misdemeanor, but the consequences aren’t minor.

A conviction can mean jail time, fines, driver’s license suspension, and a requirement to install an ignition interlock device, which prevents a vehicle from starting if the driver’s breath registers alcohol. Courts may also require an alcohol evaluation or substance abuse treatment as part of sentencing. If your BAC was 0.20 percent or higher, an “Excessive DUI” enhancement applies and carries harsher penalties than a standard first offense.

How We Defend First-Offense DUI Cases in Coeur d’Alene

We prepare first-offense DUI cases as if they’re going to trial. That means examining the traffic stop itself, the administration of field sobriety tests, and the calibration and operation of the breathalyzer before we evaluate any other options. A stop that lacked legal justification, a test administered improperly, or a breathalyzer that wasn’t correctly maintained can all affect whether evidence holds up in court.

Plea negotiation is sometimes the right path. It isn’t always. We don’t make that assessment until we’ve reviewed what the evidence actually shows. That trial-ready preparation is what puts us in a position to pursue available defenses rather than defaulting to the easiest resolution.
